1. Acceptance of Terms
By accessing or using Guild ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not use the Platform. We reserve the right to update these terms at any time, and your continued use of the Platform constitutes acceptance of any changes.
2. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Guild reserves the right to suspend or terminate accounts that violate these terms.
3. Purchases
All purchases made through Guild are between the buyer and the seller. Guild acts as a marketplace facilitator and is not a party to the transaction between buyers and sellers. Prices are set by sellers and may change without notice. You agree to pay all fees and charges associated with your purchases.
4. Refunds
Refund policies are set by individual sellers on Guild. Buyers should review the seller's refund policy before making a purchase. If a dispute arises, Guild may mediate at its discretion but is not obligated to issue refunds on behalf of sellers. Refund requests should be directed to the seller first.
5. Intellectual Property
Sellers retain ownership of all intellectual property rights in the products they list on Guild. Buyers receive a license to use purchased products as specified by the seller. You may not reproduce, distribute, or create derivative works from purchased products unless explicitly permitted by the seller. Guild's name, logo, and branding are trademarks of Guild and may not be used without permission.
6. Prohibited Conduct
You may not use Guild to engage in any unlawful activity, distribute malicious software, infringe on others' intellectual property, harass or harm other users, or manipulate reviews or ratings. Guild reserves the right to remove content and suspend accounts that engage in prohibited conduct.
7. Limitation of Liability
Guild is provided "as is" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Guild shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Platform.
8. Termination
We may terminate or suspend your access to Guild at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions of these terms that by their nature should survive termination shall remain in effect, including ownership provisions, warranty disclaimers, and limitations of liability.
